2.   Principles of data processing and storage duration

2.1.   Legal bases for the processing of personal data 

Insofar as we obtain your consent for the processing of personal data, Art. 6(1)(1)(a) GDPR is the legal basis for the processing of personal data. You can revoke your consent at any time with effect for the future.

When processing personal data that is necessary for the fulfilment of a contract with you or your company, Art. 6(1)(1)(b) GDPR is the corresponding legal basis. This also applies to processing operations that are already relevant prior to the contract.

Insofar as the processing of your personal data is necessary to fulfil one of our legal obligations, Art. 6(1)(1)(c) GDPR serves as the legal basis.
If the processing is necessary to safeguard a legitimate interest of our company or a third party and your interests, fundamental rights and freedoms do not outweigh our legitimate interest, Art. 6(1)(1)(f) GDPR serves as the legal basis for processing.

2.2.   Storage and deletion of data  

We only store personal data for as long as the specific purpose of the storage requires. If the purpose of storage ceases to apply, your data will be deleted or its processing restricted.

In addition, however, European regulations, applicable national laws or other provisions may require us to store the data we process for longer. When these data retention periods expire, we will delete your data or restrict its processing.

2.3.   Data recipients

We will generally only pass on your personal data to service providers, business partners and other third parties within the framework of the applicable data protection laws and will inform you thereof in accordance with legal requirements.

We may disclose personal data to service providers and oblige them to perform services on our behalf (order processing). In doing so, we observe the strict applicable national and European data protection regulations. The service providers are subject to our instructions and are governed by strict contractual restrictions with regard to the processing of personal data. Accordingly, processing is only permitted insofar as it is necessary for the performance of services on our behalf or to comply with legal requirements. We define in advance exactly what rights and obligations the service providers should have in relation to personal data.

We may disclose personal data to other third parties if this is required by law or a legal action or in order to provide the services we offer on the Putzmeister website. We may also be obliged to provide information to a law enforcement agency or other authority. We are also authorised to disclose data if the forwarding of information is necessary for the cooperation and thus the provision of services to you or if you give your consent.

2.3.2.   Web hosting 

Our Putzmeister website and therefore also your data are hosted by Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland ("Microsoft"). Microsoft may only access the data in accordance with our instructions (order processing). 

Microsoft also adopts strict technical measures to protect your personal data. Microsoft will not disclose your personal data to third parties unless the disclosure is necessary for the performance of the agreed services or Microsoft is required to do so to comply with the law or a valid and binding order of a government or regulatory authority. The data transmitted for this purpose is kept to the necessary minimum. 

According to its own statements, Microsoft also intends to introduce the so-called "data border for the European Union", in which Microsoft undertakes not to transfer any data from the EU to third countries. Your data is already hosted on servers in the European Union ("EU") or the European Economic Area ("EEA").

Despite these measures, it cannot be ruled out with absolute certainty that Microsoft may also store or transmit the information in/to countries outside the EEA. However, Microsoft will take the necessary steps to ensure that an appropriate level of data protection is maintained. For example, if Microsoft transfers your data to the United States, additional measures, such as concluding EU-compliant data transfer agreements with the data importer, will be taken where necessary. As a precautionary measure, we have also concluded standard contractual clauses with Microsoft to also protect a data transfer to third countries in the event that data is transferred to a third country despite the measures listed above. 2.3.3.   Forwarding of your data to affiliated companies of Putzmeister 

Some of your data will be passed on to other Putzmeister companies for the purpose of processing your contact and providing the services offered via the Putzmeister website. 

The legal bases for this data processing are Art. 6(1)(b) and (f) GDPR or order processing. If there is no fulfilment of a contract with you and no order processing, we have a legitimate interest in transferring the data to the relevant Putzmeister company and the business divisions responsible there for internal administrative purposes. This procedure enables the Putzmeister Group to offer you the services offered via the Putzmeister website as efficiently as possible. 

3.   Your rights 

If we process your personal data, you are a "data subject" within the meaning of the GDPR. As a data subject, you have the following rights vis-à-vis us:

3.1.   Right of access regarding the processing 

You can request information from us at any time within the framework of the statutory provisions as to whether personal data is processed by us. If this is the case, you have the right to request information about the scope of data processing (see Art. 15 GDPR). Please note that the right of access may be restricted in certain legal circumstances. 

3.2.   Right to rectification 

You have the right to have your data corrected and/or completed by us if the personal data processed relating to you is incorrect or incomplete (cf. Art. 16 GDPR).

3.3.   Right to restriction of processing 

If the requirements for this are met, you can request the restriction of the processing of your personal data (cf. Art. 18 GDPR).

3.4.   Right to erasure ('right to be forgotten')

You can request that we delete the personal data concerning you immediately, provided that the requirements for this are met. The right to erasure does not exist, for example, if the processing is necessary (cf. Art. 17 GDPR).

3.5.   Notification obligation regarding rectification or erasure of personal data or restriction of processing 

If you have exercised your right to rectification, erasure or restriction of processing against us, we are obliged to notify all recipients to whom the personal data concerning you has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. The controller shall inform you about those recipients if you request it (cf. Art. 19 GDPR).

3.6.   Right to data portability 

You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format. You also have the right to transfer this data to another company without hindrance from us, provided that the conditions for this are met (cf. Art. 20 GDPR).

3.7.   Right of objection 

You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is based on Art. 6(1)(1)(f) GDPR (Art. 21(1) GDPR). The consequence of the objection is that Putzmeister or the Putzmeister company responsible for the data processing will no longer process the personal data concerning you, unless Putzmeister or the Putzmeister company responsible for the data processing can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

Please direct your objection to the Putzmeister company responsible for data processing. We will inform you separately at the appropriate point in this privacy policy if the data processing is not carried out by Putzmeister Holding GmbH, but by another Putzmeister company. 3.8.   Right to revoke the declaration of consent under data protection law

If you have given your consent under data protection law, you can revoke this at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

3.9.   Right to lodge a complaint with a data protection supervisory authority 

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU member state of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes applicable data protection laws.

4.   Security standards 

We have implemented appropriate physical, technical and administrative security standards to protect personal data from loss, misuse, alteration or destruction. All service providers and affiliated companies are contractually obliged to maintain the confidentiality of personal data. In addition, they may not use the data for purposes that have not been approved by us.

As the security of your data is important, your entire visit is handled via a secure TLS connection. If personal data is collected, the data transfer is also TLS-encrypted. The TLS encryption process protects your data from unauthorised access as it travels over the Internet.

5.   Changes to the privacy policy 

We may update this privacy policy from time to time to ensure that it always complies with current legal requirements or to reflect changes to our services available via the Putzmeister website (e.g. introduction of new services). Whether anything has changed since your last visit can be seen from the date in the first paragraph of this privacy policy. 

B.   DATA PROCESSING ON THE PUTZMEISTER WEBSITE 

1.   Log data / log files 

Each time you visit the Putzmeister website, our system automatically collects data and information from your end device. In particular, the following data is collected:

  • IP address of the requesting end device
  • Date and time of access
  • Website from which the requested file was accessed (referrer URL)
  • Description of the browser and the version of the browser used
  • If applicable, the installed operating system and the set resolution
  • Name of the file and the URL of the requested file
  • Description of the access provider you are using
  • Length of time you spend on the site
  • Volume of data transferred
  • Access status (i.e. whether the file was transferred or possibly not found, etc.)

The aforementioned data is stored in the log files of our system. This data is generally not stored together with other personal data. If access statistics are created, your IP address is anonymised by the host by truncating the last bytes of the IP address. Your IP address can therefore no longer be assigned to you in the access statistics. 

The legal basis for the temporary storage of data and log files is Art. 6(1)(1)(f) GDPR. We have a legitimate interest in collecting and temporarily storing the aforementioned data, as the temporary storage of the IP address by the system is necessary to enable the website to be delivered to your end device. The temporary storage of the data also takes place to enable delivery of the website. This data is also used to optimise our website and to ensure the functionality of the website and the security of our information technology systems. The log files are not analysed for marketing purposes.

If the data is stored in log files, the data is generally deleted after 30 days. The data is stored for the purposes of system security, e.g., to be able to clarify incidents of misuse, security incidents or malfunctions. Data from log files whose further storage is required for evidence purposes is generally excluded from deletion until the respective incident has been finally clarified and may be passed on to investigating authorities in individual cases if necessary.

2.   Cookies, pixels and similar technologies 

2.1.   General information about cookies, pixels and similar technologies 

When you use our Putzmeister website, various types of cookies are used and stored on your end device. Cookies are small text files that are stored on your end devices when you visit our Putzmeister website. We acquire various information through the cookies setting. 

In addition to cookies, some services also use so-called "tracking pixels". A pixel is a 1 x 1 pixel graphic that is not visible to the average viewer, but is nevertheless present in the service. The pixel used allows certain events to be tracked if you or the programme you are using downloads the graphic.

Some services use "device and browser fingerprinting". Device and browser fingerprinting attempts to identify website visitors based on the specific settings of the respective browser or the device used to access the website. If the sole purpose of the storage or access is to carry out the transmission of a message via a public telecommunications network, the legal basis is Section 25(2)(1) TDDDG.

If the storage or access is absolutely necessary so that we can provide a service expressly requested by you, Section 25(2)(2) TDDDG is the relevant legal basis.

In the following, we will inform you about the relevant legal bases in the specific case. For the subsequent processing of personal data, we base the processing on one of the above-mentioned legal bases of the GDPR.

2.2.   Objection / cancellation

On the website, we offer you the option of searching for the dealer of our products that is closest to your immediate location. We use the Google Maps API service to show you suitable dealers. 

Data is transferred to Google regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your data will be assigned directly to your account. If you do not wish to be associated with your Google profile, you must log out before activating the button. 

Google stores your data as user profiles and uses them for the purposes of advertising, market research and/or the customised design of its website. Such an evaluation is carried out in particular (even for users who are not logged in) to provide customised advertising and to inform other users of the Google network about your activities on our website. You have the right to object to the creation of these user profiles, whereby you must contact Google directly to exercise this right.

The external fonts of the "Google Fonts" service are also integrated into Google Maps. When you access the Google Maps service, your browser loads the required web fonts to your browser cache in order to display texts and fonts correctly. For this purpose, the browser you are using must connect to Google's servers. If your browser does not support the fonts, a standard font will be used by your end device. According to Google, the data transmitted by Google Fonts in connection with the page view is sent to resource-specific domains. According to Google's own statements, the data is not associated with other data that may be processed in connection with the parallel use of authenticated Google services, such as Gmail.

2.4.   YouTube videos 

Plug-ins from www.youtube.com are integrated on our website. We use embedded YouTube videos in privacy-enhanced mode. YouTube describes its mode of operation as follows: "With the privacy-enhanced mode, you can embed YouTube videos without cookies being set to analyse user behaviour. This means that no data on user activity is collected in order to personalise video playback. Instead, video recommendations are based on the current video. Videos played in privacy-enhanced mode do not affect which videos are recommended to a user on YouTube". 

Cookies are therefore only set by YouTube when you actively activate the playback of an embedded video. Further information is available at  https://support.google.com/youtube/answer/171780?hl=en

When you access pages of our website that have a YouTube plug-in, a connection to the YouTube servers is established and the plug-in is displayed on the website by notifying your browser. This tells the YouTube server which of our pages you have visited. If you are logged in as a member of YouTube, YouTube assigns this information to your personal user accounts on these platforms. When using these plug-ins, such as clicking/starting a video or sending a comment, this information is assigned to your YouTube user account, for example, which you can only prevent by logging out before using the plug-in.

Putzmeister uses the reCAPTCHA Enterprise service to protect the registration and login process from bot registrations and other spam mechanisms via the registration form available on the website. The query is used to distinguish whether the input is made by a human or improperly by automated, machine processing. In order to do this, Google uses cookies and makes use of device and browser fingerprinting technology. 2.7.   Content Delivery Networks 

We use so-called Content Delivery Networks ("CDN") for the proper provision of the content of our website. The use of CDN enables us to make the content of our website, in particular files, graphics or scripts, available to you more quickly with the help of regionally or internationally distributed servers. When you access this content, a connection is established between you and the respective servers of the CDN, whereby personal data such as your IP address and possibly browser data such as your user-agent are transmitted to the provider of the CDN. Personal data transmitted in this way is generally stored in server log files of the respective CDN provider in order to increase the delivery speed of the website.

Below we inform you about the CDN used by us.

2.7.1.   Bootstrap (CDN) 

The website loads scripts from the CDN Bootstrap. The provider of this service is Prospect One, Kròlewska 65a, Woiwodschaft Małopolskie, 30-081 Poland ("Bootstrap").

When establishing the connection with Bootstrap's servers, personal data such as your IP address and browser data such as your user-agent may be transmitted to Bootstrap. Bootstrap may also store cookies on your computer for optimisation and analysis purposes.
The use of Bootstrap is based on Art. 6(1)(1)(f) GDPR. We have a legitimate interest in the secure and efficient provision of our website, as well as in shortening the delivery speed of our website. 

Your data will only be processed by Bootstrap for as long as is necessary for the purpose of data collection. We cannot influence the specific storage period of the processed personal data. 2.7.2.   Cloudflare (CDN) 

We also use the CDN of Cloudflare Inc, 101 Townsend Street, San Francisco, CA 94107 ("Cloudflare"). 

When establishing the connection with Cloudflare's servers, personal data such as your IP address and browser data such as your user-agent may be transmitted to Cloudflare's servers. To the best of our knowledge, Cloudflare collects the following data:

  • Name of the file
  • Date and time of retrieval
  • Volume of data transferred
  • Notification of whether the retrieval was successful
  • Browser type and browser version used
  • Details of the user's operating system
  • Previously visited website (referrer URL)

Cloudflare may also store cookies on your computer for optimisation and analysis purposes.

It is possible that your data may be transferred to servers outside the EU and the EEA. We have concluded an order processing contract with Cloudflare, in which Cloudflare undertakes to process data exclusively in accordance with our instructions. In addition, we have concluded so-called standard contractual clauses with Cloudflare as appropriate guarantees in accordance with Art. 46 GDPR. 3.   Newsletter

We offer a newsletter with information and advertising (e.g. customer information and customer care, invitation to product presentations, notification of technical innovations, service and sales campaigns, customer magazines, customer satisfaction survey) by post and e-mail.

If you would like to subscribe to our newsletter, you must enter the e-mail address at which you would like to receive the newsletter. The newsletter will only be sent with your express consent. After entering your e-mail address, you will receive a confirmation e-mail to the e-mail address you entered. The newsletter will only be sent after explicit confirmation by clicking on a link in the confirmation e-mail (so-called double opt-in).

Purposes of the processing
Your e-mail address is collected and stored so that we can send you the newsletter.

Legal basis
Your data will be processed by us for advertising purposes on the basis of your consent in accordance with Art. 6(1)(a) GDPR.

Duration of data storage
Your e-mail address will be stored until you unsubscribe from the newsletter.

Opt-out option
If you do not wish to receive any advertising, you can object to the further use of your data for advertising purposes / revoke your consent at any time by sending an e-mail to abmeldung@putzmeister.com or by clicking on the "Unsubscribe from newsletter" button. We will no longer process your data after receipt of your cancellation notice. If you wish, we can save your data in a blacklist so that you do not receive any further messages. 4.   Contact form 

Putzmeister offers you the opportunity to get in touch with Putzmeister via a contact form on the website. If you contact us via the contact form, the data entered in the fields will be transmitted to us and stored. This includes in particular your name, your e-mail address and all other data entered in the fields. 

In some cases, it is necessary to forward your data to other Putzmeister companies or other third parties in order to process your enquiry in the best possible way by the responsible contact person and the responsible department. 

The legal basis for the processing and transmission of the data entered via the contact form is Art. 6(1)(1)(a), (b) or (f) GDPR. The processing and transmission of the personal data entered in the contact form are used solely to process your request and contact you. This is in our interest. This may also be a contract initiation. 

The data will be deleted as soon as it is no longer required to fulfil the purpose for which it was collected and the deletion does not conflict with any statutory archiving obligations. Data processing for the purpose of processing the enquiry via the contact form is in any case completed when it can be inferred from the circumstances that the matter in question has been conclusively clarified.

5.   Jobs and career 

On our website, we publish job advertisements for vacant positions within the Putzmeister Group in our company's own job portal.
You can apply for the advertised positions directly in the respective job advertisement via the online portal. 

As part of your application process, we process the data that you provide us with. This can include the following data in particular:

  • Your full name
  • Your full address
  • Your telephone number
  • Your e-mail address
  • Your possible starting date and notice of termination, if applicable
  • Your salary expectations
  • Your application photo
  • Your date of birth
  • Your place of birth
  • Your nationality
  • Your gender
  • Your application documents such as cover letter, certificates, CV
  • Details of your school education, studies, vocational training and further training
  • Your language skills
  • Your IT skills
  • Other qualifications and your motivation
  • Details of your professional career

Data processing as part of the application process serves to decide on the establishment of an employment relationship between you and the respective Putzmeister company where the vacant position is to be filled. The primary legal basis for this is Art. 6(1)(1)(b) GDPR or Section 26(1) BDSG or comparable national regulations. Personal data will only be processed for purposes related to your interest in current or future employment with the respective Putzmeister company and the processing of your application.

The centralised HR department at Putzmeister Holding is responsible for receiving, coordinating, managing and forwarding applications within the Putzmeister Group. If Putzmeister Holding does not fill the vacant position, your application will be forwarded to the company where the respective vacancy is open or to which your unsolicited application is to be assigned. Insofar as Putzmeister Holding is not itself responsible for the further processing of the application as a potential hiring company, Putzmeister Holding will act on the basis of an agreement on joint responsibility. Putzmeister Holding is also available to you as a central point of contact for data protection issues in connection with the application process, to whom you can assert your data protection rights and who will coordinate the processing of your data subject rights. Your application will only be processed and acknowledged by the relevant contact persons at the respective Putzmeister company. Your application documents will only be forwarded to the relevant department in the respective company for the candidate selection. All employees entrusted with data processing are obliged to maintain the confidentiality of your data. Under no circumstances will other third parties gain knowledge of your data unless we inform you of this in this statement. We use a specialised software provider for the application process. This company acts as a service provider for us and may also obtain knowledge of your personal data in connection with the maintenance and support of the systems. We have concluded a so-called order processing contract with this provider, which ensures that the data processing is carried out in a permissible manner.

If the respective Putzmeister company is unable to offer you employment, the data you provide will generally be stored for up to four months after rejection for the purpose of answering questions in connection with your application and rejection, provided that no other statutory retention obligations apply.

6.   Product and colour configurator 

You have the option of using the MY PM service product and colour configurator on our Putzmeister website without being registered with MY Putzmeister or logged into your MY Putzmeister user account. Further information on data processing when using the product and colour configurator can be found here.

C.   DATA PROCESSING OPERATIONS WHEN USING MY PM SERVICES 

1.   Controller

Putzmeister Holding GmbH is the controller for the "MY Putzmeister" platform within the meaning of the GDPR. Digital services for products of the Putzmeister Group ("MY PM services") are accessible via MY Putzmeister. For the individual MY PM services, other Putzmeister companies may be the controller within the meaning of the GDPR. We will notify you thereof if this is the case. 

2.   Registration for MY Putzmeister 

In order to use MY Putzmeister and the services available via MY Putzmeister, it is necessary to register and create a user account with MY Putzmeister. 

MY Putzmeister offers both companies that offer the products for purchase or rental to other companies ("dealers") and the respective companies that purchase or rent the products ("end customers")(dealers and end customers hereinafter jointly referred to as "companies") an opportunity to access additional specialist information on the products via the MY PM services, as well as to use additional services via MY Putzmeister in connection with the products of the Putzmeister Group.

2.1.   Registration process for MY Putzmeister

Company employees can register for MY Putzmeister. When registering for MY Putzmeister, you are required to provide certain mandatory information as well as voluntary information, which is marked separately. 

We use, store and process this data as this is necessary to establish, organise or change the content of the user relationship between you and us and to use the MY PM services offered via MY Putzmeister.

If you have successfully registered, you can log in to your user account once it has been activated. We use, store and process your data used for registration, such as your e-mail address and the password you set, so that you can log in to MY Putzmeister and access the MY PM services made available there for retrieval.

The legal basis for the aforementioned data processing in the context of registration for MY Putzmeister is Art. 6(1)(1)(b) and (f) GDPR. We delete your data if it is no longer required for the stated purpose and there are no contractual or statutory retention periods. 

2.2.   Activation process 

In order to check whether you as an employee are authorised to use MY Putzmeister on behalf of the company, Putzmeister may transmit the details entered during your registration to the company or your employer's dealer before activating your profile. In this case, your data entered during the registration process will be transmitted to the company or dealer in order to check whether you belong to the company and are authorised to use MY Putzmeister and the MY PM services. 

The legal basis for the aforementioned data processing in the context of the activation process for individual MY PM services is Art. 6(1)(1)(b) and (f) GDPR. We delete your data if it is no longer required for the stated purpose and there are no contractual or statutory retention periods. 

2.3.   Accessibility of data for other users 

Other users of MY Putzmeister can see your contact information as part of the MY PM service MY Fleet within the scope of the intended use of MY Putzmeister, provided that this information is stored with MY Fleet.

3.   MY PM-Service: Product and colour configurator 

Controller within the meaning of the GDPR: The product and colour configurator is a service provided by Putzmeister. 

You have the option of requesting that we implement the configuration you have made. If you are logged in to MY Putzmeister, you can send the configuration without entering any further data. The configuration you send is automatically assigned to the data you have stored in your MY Putzmeister user account. 

If you do not have a user account with MY Putzmeister, you can also request the configuration you have made. To do this, you can either complete an enquiry form or send the code assigned to the relevant configuration to a Putzmeister Group dealer or sales contact (e.g. by e-mail). 
If you request the configuration from us using the enquiry form or by e-mail, the data entered in the fields or provided by e-mail will be transmitted to us and stored. This includes in particular your first name and surname, your e-mail address and all other data entered in the fields or provided by you in the e-mail. 

The legal basis for the processing of the data transmitted as part of the configuration enquiry is Art. 6(1)(1)(b) or (f) GDPR. The processing of personal data is used solely to process your configuration enquiry and to contact you. This is in our interest. This may also be a contract initiation.

We transmit your personal data entered in the configuration request to the Putzmeister company responsible for realising the corresponding configurations within the company. The legal basis for the processing of the data transmitted as part of the configuration enquiry is Art. 6(1)(1)(b) or (f) GDPR.

The data will be deleted as soon as it is no longer required to fulfil the purpose for which it was collected and the deletion does not conflict with any statutory archiving obligations. Data processing for the purpose of processing the configuration enquiry is in any case completed when it can be inferred from the circumstances that the matter in question has been conclusively clarified.

4.   MY PM Service: Warranty Tool 

Controller within the meaning of the GDPR: The Warranty Tool is a service provided by Putzmeister.

Putzmeister offers you the option of using the Warranty Tool to digitally process warranty claims on behalf of the company ("Warranty Application") for products that are subject to warranty or special complaint regulations or for which the Putzmeister companies have assumed a warranty.

As part of the warranty application, various data on the product, the defect and any repairs already carried out on the defect are requested. If you decide to report a warranty case via the Warranty Tool, the data entered in the fields will be transmitted to Putzmeister and saved. This includes in particular your e-mail address used for registering with MY Putzmeister and all other data entered in the fields.

After you have sent the completed warranty application form, Putzmeister will forward it with all the data you have provided to the Putzmeister company that placed the defective product on the market and is responsible for processing the warranty claim within the Putzmeister Group. The data will be transmitted exclusively for the purpose of processing the warranty case reported by you. 

The legal bases for the aforementioned data processing are Art. 6(1)(1)(b) and (f) GDPR. We delete your data if it is no longer required for the stated purpose and there are no contractual or statutory retention periods. 

5.   MY PM Service: MY Fleet 

Controller within the meaning of the GDPR: MY Fleet is a service provided by Putzmeister.

Via MY Fleet, Putzmeister offers you the opportunity to centrally manage the company's entire fleet of machines on behalf of the company, to call up individual information on the machines and to obtain an overview of upcoming maintenance work ("Upcoming Services") on the machines in the fleet.

MY Fleet gives you the opportunity to enter your contact details as a contact person for the company, including your name, e-mail address and telephone number. As an employee of the machine's end customer, you also have the option of registering as a contact person for services to be performed on the machines in the fleet. You can also select within the input fields for the contact details whether you would like to receive notifications about upcoming services at the e-mail address you have provided. In these e-mail notifications, we inform you when the service status of a machine has changed (e.g. information about upcoming or overdue maintenance work on the machine). You have the option of removing the contact data you have stored at any time. Companies can also create checklists for their fleet.

Putzmeister processes the data provided by you solely to provide the services within the scope of MY Fleet and to send you the aforementioned e-mail notifications regarding the service status. The data stored by end customers can be viewed by the dealer registered with the machine, provided the dealer is also authorised to access MY Fleet. This ensures that the dealer has access to the end customer's current contact details and can help them with any service problems with the machine. This does not apply to the checklists; these cannot be edited by the dealers.

If dealers are authorised to access MY Fleet, the dealer's employees can enter their contact details as contact persons for end customers. The data stored by the dealer's employees can be viewed by the end customer registered with the machine.

The legal bases for the aforementioned data processing are Art. 6(1)(1)(b) and (f) GDPR. We delete your data if it is no longer required for the stated purpose and there are no contractual or statutory retention periods.

6.   MY PM-Service: Express service list 

Controller within the meaning of the GDPR: Express service list is a service provided by Putzmeister.

Putzmeister offers you the option of reserving the machines shown in the express service list without obligation by sending an enquiry to the Putzmeister Group sales department on behalf of the company. 

The data you provide in the reservation enquiry (e.g. name, company, contact details, etc.) will be transmitted to Putzmeister and stored by Putzmeister. Putzmeister will forward your reservation request and the data contained therein to the responsible office within the Putzmeister Group so that your reservation request can be processed by the responsible office.

The legal basis for the data processing is Art. 6(1)(1)(b) or (f) GDPR. The processing and transmission to other companies of the Putzmeister Group of the personal data contained in the reservation enquiry is used - in addition to the above-mentioned purposes - solely to process your reservation enquiry. This is in our interest. The reservation enquiry is usually also a contract initiation. 

The data will be deleted as soon as it is no longer required to fulfil the purpose for which it was collected and the deletion does not conflict with any statutory archiving obligations. 

7.   MY PM-Service: Machine Cockpit

Via Machine Cockpit, Putzmeister Engineering GmbH offers you the option to use data from machines with activated Connect Box, among other things for the optimisation and evaluation of your own business processes, as well as to obtain information about critical machine states and services to be carried out on the machines. Connect Boxes do not process personal data within the meaning of the GDPR. The Putzmeister Group may read out the machine data recorded by the Connect Boxes and transmitted to the Putzmeister Cloud Server via data transfer in accordance with the terms of use for MY Putzmeister [please link] and use it for analyses for the purposes listed there. 

You receive messages on maintenance intervals and critical machine states directly within the Machine Cockpit. In addition to this, we use the e-mail address provided by you during registration to send you e-mail notifications about upcoming maintenance intervals and critical machine states. 
The legal bases for the aforementioned data processing are Art. 6(1)(1)(b) and (f) GDPR.

The MY PM service Machine Cockpit and therefore also your data are hosted by Amazon Web Services EMEA SARL, 38 Avenue John F. Kennedy, L-1855 Luxembourg ("Amazon EMEA") and Amazon Web Services Inc., 410 Terry Avenue North, Seattle WA 98109, United States (hereinafter referred to as "Amazon USA"; referred to jointly as: "Amazon"). 

Amazon EMEA processes and stores your data as a user of the MY PM service Machine Cockpit, irrespective of the region in which you log in. The machine data collected as part of the use of the MY PM service Machine Cockpit which is not personal data, is processed and stored by Amazon USA for Putzmeister machines that are sold in the United States of America. Machine data from all other machines is processed and stored by Amazon EMEA.
Amazon may only access the data in accordance with our instructions (order processing). Amazon also adopts strict technical measures to protect your personal data. Amazon will not disclose your personal data to third parties unless the disclosure is necessary for the performance of the agreed services or Amazon is required to do so to comply with the law or a valid and binding order of a government or regulatory authority. The data transmitted for this purpose is kept to the necessary minimum.

Amazon may also store the information in countries outside the European Economic Area. However, Amazon will take the necessary steps to ensure that an appropriate level of data protection is maintained. For example, if Amazon transfers your data to the United States, additional measures, such as concluding EU-compliant data transfer agreements with the data importer, will be taken where necessary. 8.   MY PM Service: Web Shop

Controller within the meaning of the GDPR: The web shop is a service provided by Putzmeister.

8.1.   Purchase and inquiry of products via the web shop

You can order products on the Putzmeister website via your MY Putzmeister account. Guest orders are not possible. If you do not have a MY Putzmeister account, you can only enquire about the products. 

If you order via your MY Putzmeister account, a large part of the data you have stored in your account will be automatically used to process the order. This data does not need to be entered again. Your personal data required for the execution of the order will be transmitted to the Putzmeister company that sells the product and thus realises the order.

If you would like to send an enquiry about a product, please enter the following data:

  • E-mail address
  • Correct name of the company
  • First name and surname
  • Address of the company/ordering party
  • Country

Other data that you can enter, such as the enquiry text and salutation, are optional.

Putzmeister uses, stores and processes this data as this is necessary to establish, organise or change the content of the user relationship between you and Putzmeister and for the utilisation and invoicing of the relevant services as well as for the initiation of contracts for requested products.

The legal bases for the aforementioned data processing are Art. 6(1)(1)(b) and (f) GDPR. 

8.2.   Payment by credit card

If you decide to pay by credit card, the payment will be processed by the payment service provider Adyen N.V. German Branch, Friedrichstrasse 63, 10117 Berlin ("Adyen"). 

If you pay by credit card, Adyen collects the following data:

  • Name of the credit card holder
  • Credit card number
  • Expiry date of the credit card
  • Security code

Putzmeister does not collect and store the payment data itself. This data is collected directly by Adyen. In addition to the payment data provided, Adyen only has knowledge of the order number and the invoice amount, without being able to assign this information to other information.

Putzmeister complies with the highest security and data protection standards when working with Adyen. Adyen complies with the requirements of the "Payment Card Industry (PCI) Data Security Standards" and has been certified according to Level 1 of the PCI Standard (you can find more information on this here: https://www.adyen.com/de_DE/plattform/zertifizierungen). Adyen is also audited by the Payment Card Industry Security Standards Council for compliance with the PCI Standard.

Adyen also states that it fulfils the requirements of the European Union (EU) Payment Services Directive 2015/2366 and all other relevant regulations.

The legal basis for data processing is Art. 6(1)(1)(b) GDPR. Your data will be processed exclusively for the purpose of payment processing with the payment service provider Adyen and only to the extent necessary for this purpose.

D.   PUTZMEISTER GROUP ON SOCIAL MEDIA 

1.   General information about data processing by social media platforms

We operate publicly accessible company profiles on social media platforms to provide information about our new products, events and to give insights into the company of Putzmeister and other companies belonging to the Putzmeister Group. It is also possible to contact you as a user/visitor of the social media platforms. The platforms on which we operate a company profile can be found below in section 6.

Social media platforms such as Facebook, Twitter, etc. can generally analyse your user behaviour comprehensively when you visit their website or a website with integrated social media content (e.g. Like buttons or advertising banners). Visiting our social media pages results in numerous data protection processing operations. The respective social media platforms can provide us with anonymised statistics and insights about interactions with our posts, among other things. From this information, we can recognise whether our website has been reached by users/visitors from the respective platform via our company profile and, among other things, the age/gender groups (the latter only for logged-in users). We have no influence on the data transmitted to us and cannot stop this procedure on the part of the social media platforms. We use the data transmitted to us to optimise our posts and our website and to design it in accordance with the interests of our website visitors.

The social media platforms store cookies on your end device or record your IP address. This serves to evaluate the data of the visit to the social media platform and our company profile for statistical and market research purposes and can help to optimise future advertising measures on the part of the social media platforms. It is possible that the social media platforms themselves may use the data collected about the user behaviour of users/visitors to display personalised advertising, which can be displayed on all devices on which you are/were logged in.

If you are logged in to a social media platform when you visit our company profile, the data from your visit to our company profile can be assigned to your account and linked to the data in this account. We would like to point out that it is possible that social media platforms may collect your data even if you do not have an account.

Depending on the platform, further processing operations may be carried out. For further details, please refer to the terms of use and data protection notices of the respective social media platforms.

2.   Legal basis 

Putzmeister has a legitimate interest in the operation of the company profile and the processing of your data in order to be able to design and implement modern options of notification and communication accordingly. The legal basis in this case is Art. 6(1)(1)(f) GDPR.

If you contact us via the message function or via the e-mail address stored in our company profile, we will store your user profile ID or e-mail address as well as other data you provide. The legal basis for the processing is Art. 6(1)(1)(b) GDPR, insofar as the contact is a contract initiation or contract-related topics. We also have a legitimate interest in processing your data in order to be able to respond to your enquiry, Art. 6(1)(1)(f) GDPR.

The analysis methods used by the social media platforms may be based on different legal bases, which must be specified by the operators of the social media platforms (e.g. consent within the meaning of Art. 6(1)(1)(a) GDPR, consent can be revoked there at any time).

3.   Controller 

According to a decision of the European Court of Justice, fan page operators (including us) are joint controllers within the meaning of the GDPR together with the social media platform.

Due to the collection and storage of data (and user data) by the social media platforms, you can also assert your rights against the respective platform. You can find your rights vis-a-vis us under section A.3.

4.   Storage period

The data will be deleted as soon as it is no longer required to fulfil the purpose for which it was collected and the deletion does not conflict with any statutory or contractual archiving obligations. If you contact us via the message function or the e-mail address stored in the company profile, the conversation is ended when it can be inferred from the circumstances that the matter in question has been conclusively clarified.

If you decide to share the content of our Putzmeister website on social networks such as Facebook, X, XING, Pinterest, etc., the data protection provisions of the respective social media platform apply. 

No plug-ins provided by the social networks Facebook, Twitter, Pinterest etc. are integrated on our Putzmeister website. There is no automatic transfer of user data to the operators of these platforms on our Putzmeister website.
